Terms and Conditions

This contract is made between “Villa/Apartment” tenant (hereinafter referred to as “Customer”) and “Villa/Apartment” renter (hereinafter referred to as “Monix Homes “) regarding renting of the holiday home (hereinafter referred to as “Villa/Apartment“) for holiday purposes during the specified period and determining the liabilities of the parties.

Customers who have made reservation via “http://www.monixhomes.com.tr” ,our website, telephone or e-mail are considered to have accepted the following conditions in advance. Any breach of any of the following conditions gives “Monix” the right to cancel the reservation unilaterally, to ask the customer to leave the villa/apartment, to withdraw the deposit and claim all of the unpaid rent.

You must be at least 21 years old to make a booking with us. Email confirmation of your booking will be sent to you once the reservation deposit is received. You will be notified for the remaining payments and confirmed when payments are received via email. The contract is subject to these booking terms and conditions, all booking conditions will apply to each and every booking made with the Company. Once the contract is made, it is our responsibility to provide you with what you have booked and it is your responsibility to pay for the accommodation in full before you travel. All relevant documentation will be sent to you via email, it is important to check carefully all the details of your booking once you received it. The Company will not be responsible for any information you do not receive as a result of your failure to provide a valid email address.
 
A non-refundable deposit of 20% (or whatever percentage is agreed mutually) of the accommodation rental is payable when you book your holiday, the balance is due 8 weeks before departure (in some cases, a larger deposit and/or earlier final payment is required, in which case  we will notify you at the time of booking). The balance due date is shown on your confirmation so please make a note of it as no reminders will be sent. If you book less than 8 weeks before your arrival date, the full balance will be due immediately. Monix Homes reserves the right to cancel the booking and retain any deposit paid should the balance payment not be received as cleared funds by the due date.

Pre-bookings via our reservation form on our internet page or via SMS or telephone or e-mail.

You can specify your dates for renting the villa/apartment you would like to rent, provide personal/family details and any other information you would like to share and send it to us. Upon availability and agreement on the rental, you will be asked to pay %20 of the total rental price for the villa/apartment as a deposit payment. The apartment/villa will be tentatively reserved until your payment is cleared. If you pay within 2 (two) business days after the pre-rental, the villa/apartment will be reserved and you will be notified of the ascertained reservation and receipt of your deposit payment

The remaining rent amount of the Villa/Apartment must be paid to Monix or the villa/apartment Owner 8 weeks prior to the date of arrival. You may be asked to pay an additional security deposit against damage and loss of items in the villa with your final payment. This security deposit will be returned immediately or latest by 10 days after your departure should we have confirmed that there is no damage or loss at the villa/apartment.

Access to the rental villa/apartment is granted after 3pm on the first day of rental and we will ask you to vacate the property by 11am at the latest on the agreed departure date, to enable cleaning and preparations for the next guests. Please bear these times in mind when booking your flights. Some flexibility with these times may be possible, subject to availability and in some cases, at additional cost, however, this would be at the discretion of Monix Homes or the owner and must be by prior arrangement.

If early departure is required, the Monix Homes must be informed 24 hours in advance. If the customer leaves the villa/apartment at his / her own discretion, no refunds will be made for the accommodation fee. If the customer leaves the villa/ apartment without the inspection of the villa/apartment, without damage check then the damage deposit will be sent by the villa / apartment owner to the bank account that the customer will notify after the necessary checks within 10 days and the shipping costs will be paid from the damage deposit.

We do not accept guests over the capacity stated on our website or the number of people specified when making the reservation. (Children and infants are included.) If the customer wishes to make a change in the number of people after the reservation is finalized, the application will be made in writing to Monix Homes and the change can be approved if Monix considers it appropriate for the capacity of the villa/apartment. Monix Homes may or will charge an additional fee to the customer before or after entering the villa/apartment. No additional guest are accepted other than the guests whose names and date of births are specified on the booking list. In cases when this conditions is breached, Monix Homes reserves the right to request guests to leave the villa / apartment, to cancel the reservation completely or to request the villa / apartment to be completely evacuated without waiting for the end of the rental period. In the course of renting the villa/apartment, transactions are being carried out in line with the customer’s declaration, and all responsibilities arising on this issue shall be accepted, provided that the information given by the customer is correct and complete.

The lead guest is the person or agency that holds the booking, to whom all correspondence and invoices are addressed and who is responsible for the rental. Spouse’s names are not considered interchangeable. Where a booking is made by telephone, email or fax, the booking is subject to, and the guest must accept these Internet terms and conditions and any made by our suppliers. Where two or more people are included in the same booking, the person making the booking shall be deemed to do so, on the basis that he/she acts as an agent for all members of the party and accepts these booking conditions on behalf of each member of the party.

Daily, weekly, monthly villa/apartment rental rates include cleaning of 1 (one) weekly cleaning and towel/linen change per week. These cleanings are included in the price. Apart from that, all kinds of cleaning and towel/linen etc. will be charged extra. The pool, terrace and garden areas are maintained on a regular basis mostly early mornings, and if the villa/apartment experience any technical problems during the rental period, this problem will be fixed by our technical team providing this service to the villa/apartment. In order for these services to be carried out without delay, the customer must allow staff members to enter the villas/apartments if deemed necessary.

Unless agreed otherwise, electricity, water, gas, internet connection are included in the prices unless stated on the villa/apartment detail page on our website. Pool lighting, air conditioning and internet may not be available as standard in some of our our villas/apartments, so we recommend you to read all details and amenities of the villa/apartment you are renting carefully from our website and villas/apartments or properties page.

With the condition that you let us know of your pet’s size, type and other specs and as long as they are human and child friendly, we may allow pets in and around the villa. You may be asked for a pet deposit against the damages and cleaning. Special restrictions, such as no pets inside, or always on leash outside may be applied. All of our villas / apartments are non-smoking in closed areas.

Cancellations can be made by post and signed by the lead name on the booking or by email received from the lead name on the booking via the email address registered on the booking. Cancellations will become effective from the delivery date of the cancellation letter or email. All cancellations are subject to a charge payable by the customer as detailed below; charges for cancelled bookings will be confirmed to you by invoice within two weeks of cancellation. Please note: these charges also apply, if you have failed to make payment on time and we cancel your booking as a result. In addition, your booking will be treated as cancelled and the same charges will apply if you decide to change your accommodation from one property to another.

Charges above represent a percentage of the total accommodation booking value. No refunds can be given for stays that are ended earlier than planned. No party may challenge the validity of a signed fax/emailed copy of the booking conditions on the basis of a lack of original signature.

You have the right to make changes on the dates you make reservations, but there are a number of conditions.

The change is only valid for the same villa and the booking change fee is no less than 200 TL or as requested via email The change of your booking date even a day means that all forms sent to you and the hosts are changed and resubmitted. This fee is demanded to compensate the workload.   However you can not make this change if your date of arrival is less than 45 days. Because there is very little possibility for us to rent the v illa/apartment to another guest.

A damage deposit may be charged to the customer depending on the nature of each villa/apartment or guest conditions. The amount of this deposit will be stated in the confirmation letter sent to the customer during the booking process. The damage deposit will be collected together with the total payment 8 weeks before the entrance to the villas / apartments and will be returned to the bank account indicated by the guest within 10 days. If no damage to the villa/apartment detected after check-out procedure is completed. If the damage in the villa/apartment exceeds the safety deposit amount received, the customer will be asked to pay the damage non-compliance of which will give Monix Homes right to seek compensation through legal collection procedures.

The information and descriptions supplied regarding the rental property are believed to be accurate and offered in good faith, however, there may be occasions when an advertised facility is either modified or is not available. Such situations may be dictated by local circumstances, necessity for maintenance or repair (eg: swimming pools), unsuitable weather conditions, fuel shortages, power cuts or other circumstances beyond our control. If we are advised of any such issues, we will endeavor to inform you in advance, however Monix Homes cannot be held liable in such circumstances.

Monix Homes is responsible of the villa/apartment to be delivered to the customer in a clean and ready-to-use manner at the specified date and time. Upon entering the villa/apartment, the customer must be immediately notified of any defective, unworkable items or defects, and the defects should be remedied. Monix Homes will notify this claim to the villa/apartment owner or the related service company and will arrange for this imperfection to be resolved as soon as possible. Monix Homes is not responsible for solving the problems although it helps and coordinates attendance to the issues and solve problems. Any accident, illness, injury, drowning in the pool, death, theft etc that may happen during the stay, will be responsibility solely of the Customer. In no way and manner Monix Homes can be held responsible for events and accidents. Similarly, any issue or claim of unsatisfaction that may arise from a service, food, beverage, entertainment, activity etc. or merchandise purchased from third parties during customer’s stay in the villa/apartment will be of customer’s responsibility. The customer cannot claim any rights or refunds for a service that he/she has not received in the villa/apartment for the duration of his/her stay.

None of the villa/apartment rented through this web-site is owned by Monix but is advertised and rented on any website of Monix Homes. The owners of each villa/apartment are different people, individuals, institutions, companies. Monix Homes is the agent (the commissioner) for renting the villa/apartment to real and legal persons.

Depending on the renting model agreed with the owner, Monix Homes will issue invoices to the customers for the total or commission amount of the rental price paid. Invoices must be made out to the name of primary booking lead as this is regular checked by the tax office.  

It is your responsibility to ensure that:

  • any specific passport, visa and health requirements for travel are obtained.
  • all members of your party, including infants, have a valid passport.
  • each member of your party is covered by adequate travel insurance to cover all aspects of your holiday (including cover for cancellation, curtailment, evacuation, flight delays, loss and damage to baggage and other personal property as well as comprehensive health insurance including medical expenses and repatriation coverage). If you fail to take out adequate insurance coverage, we will not be liable for any refunds or losses, howsoever arising, in respect of which insurance cover would otherwise have been available.
  • the balance of your holiday is paid by the due date on your confirmation invoice.
  • please be advised that in the event that you or any of your party are disruptive or behave in an unsociable manner we do reserve the right to terminate your holiday and will have no further liability or responsibility to you in respect of accommodation or transfer/car hire, nor will any refunds be made.
  • during the period of the holiday, you (personally and on behalf of all other people visiting the property) undertake (for the benefit of the property owner and the Company) as follows:
  • that the number of people occupying the property will not exceed the number stated on the holiday confirmation.
  • that the property will be used solely for the purpose of the holiday by you and your party.
  • to show due consideration for other parties (to include, but not limited to, refraining from abuses of the property and/or dangerous, offensive or rude behavior to the property owner, his representative or any third parties such as neighbors).

 

Customers are obliged to use the villa/apartment, pool, garden furniture carefuly all other electrical and electronic goods and other furnishings in good manner as they would do with their own. Villa/Apartment must be delivered on the day of departure with all the garbage dumped and the dishes washed. Otherwise, and if the villa/apartment is dirty above reasonable measures, Customers may be charged a cleaning fee. If they have a security deposit being held this fee will be deducted.
In case of any damage to the villa/apartment, the customer is obliged to inform Monix. In the event of any damage at the villa/apartment during the period when customers are staying, the cost of mending will be deducted from the damage deposit if the damage deposit is taken or the customer will be asked to pay in cash in case of damage exceeding the damage deposit.

Additionally, customers and associates should take care to comply with social and ethical rules, not to make noise in a way that disturbs the environment, to listen music louder than expectable levels, not to be violating local ordinance and general laws or involved in criminal activity In the case that any such complaints are received by Monix about the customer and the associates, Monix Homes has the right to ask the customer to vacate the villa/apartment before the end of their scheduled and paid stay.

The Customer must read, understand and sign the “Villa/Apartment Tenancy Agreement” before checking in to the villa/apartment rented through Monix Homes. It is understood that client read, understood and irrevocably understand the rules, specifications and conditions of the villa/apartment rented as is and as advertised or explained. No monies will be refunded or compensated by Monix Homes for any complaints made by the customer for whatever reason.   You can request a copy of the villa/apartment rental agreement from our website or from Monix Homes team.

The ‘Season’ in Kaş runs from mid May to mid October. During this time building and construction work is prohibited in Kaş metropolitan area and the peninsula. If you wish to make a booking outside of these dates, it is possible that construction projects may be going on in the area. We will do our best to inform you of such situation. Monix Homes cannot be expected to be aware of all building projects in the area and so bookings outside the ‘season’ cannot be guaranteed to be unaffected by construction works.

Customers will immediately report their complaints to Monix Homes during the time they are staying in the villa/apartment. The situation of the complaint will be examined by Monix Homes Team and necessary measures will be taken immediately. Monix Homes will not be held liable for any complaints that are not reported during the stay, after the stay is over and after leaving the villas/apartments.

Monix Homes will not share personal information with any company or third party except as defined in the Privilege Privacy Policy and User Agreement.  Monix Homes never sells the personal information of registered users and partners to third parties. Personal information such as name, surname, address, telephone number or e-mail address. Monix may use personal information to determine user profiles and statistical studies in its own domain and may only share it with third parties for the purpose of conducting such studies. Monix does not take the necessary precautions to prevent personal information from strictly private and confidential, to regard it as an obligation to maintain confidentiality, to prevent unauthorized use of all or any part of the confidential information in the public domain. Even though Monix Homes takes all necessary security measures, Monix Homes will not be held liable if the confidential information is stolen or damaged by third persons that were hired to do work on our website “http://www.monix.com.tr” and if any cyber attack takes place on the system. “http://www.monix.com.tr” does not bear any responsibility for the privacy practices and content of the sites accessed through the link “http://www.monix.com.tr” uses and uses the IP addresses of the users when necessary. IP addresses can also be used to identify users in a general way and to collect comprehensive demographic information.

1) Monix Homes cannot be held responsible for any unusual or imperfect road and drive way conditions, winey roads, uphill, not perfectly lit or wet etc. that are beyond reach and possibilities of Monix Homes.

2) Monix Homes cannot be held responsible for any kind of negative and unwanted experience including but not limited to fights, accidents, injuries and sicknesses that may occur during transportation and stay at the Villa/Apartment.

3) Monix Homes cannot be held responsible if any material used for the construction of the premise (cedar wood, pine wood, some plastic products) or all kinds of plants in the garden or terrace etc. disturb the customer, cause allergic reaction or discomfort physical or physiological.

4) If the villa/apartment requires private car for the guests to stay It is the customer’s responsibility to source that to Access the villa/apartments.

5) The customer may get taxi, transfer vehicle or rental vehicle services from third parties their own risk. Monix Homes is not responsible from such third parties involved in transfer or taxi service.

6) Monix Homes cannot be held responsible if the customer is dissatisfied due to the geographical location, architectural design of the villa/apartment or the area where it is located

7) Monix Homes has marked the location of the villa/apartment as approximate via Google Maps or other available means.

8) Customers park at designated or common areas at their own risk and Monix Homes cannot be held responsible for the damage to the private or rented vehicle during the stay at the villa/apartment.

9) Villa/Apartment is too uphill for the engine power of the vehicle (motor, car etc.) of the customer who has been rented, if the vehicle’s motor power is weak, Cars, engines etc. And any negativity that may arise due to the inability to reach the villa/apartment is the customer’s own responsibility. Monix cannot be held responsible for such or similar problems.

10) Any information given and specified on the “http://www.monix.com.tr” detail page about Villa/Apartment is written approximately. The distances are not clearly specified. Minor mistakes can happen. The customer who rents the Villa/Apartment agrees to consider it.

11) The distances indicated  on the detail page “http://www.monix.com.tr.com” about the Villa/Apartment, the nearby restaurants, beaches, settlements, airports etc. Monix Homes will not accept responsibility if the specified restaurants or markets are closed or not in operation any given time.

12) Monix Homes cannot be held responsible for any physical injury or death caused by any accidents such as drowning, falling, cutting, breaking of arms or legs etc. during customer’s stay in the pool or in and around the villa/apartment.

13) Monix shall not be held responsible for the interruption of telephone and internet due to telecommunication, electricity interruption caused by the Electric Company, fire, electrical leakages, and deaths resulting from all accidents and events caused by the customer in Villa/Apartment.

14) The villa/apartment we have on our site aren’t the same as each other and they may not look as the same as they are seen on the site, they may look better on the site, they may look bigger on the site. Monix Homes cannot be held responsible for such occurrences.

15) Monix Homes cannot be held responsible for events such as canine attacks, insect bites or any kind of animal attacks.

Upon confirmation of booking, It is considered that the customer has accepted all conditions mentioned hereinabove at this contract, Monix Hoımes may use the right to terminate the contract singlehandedly and demand a contractual price if the lease contract is breached by producing unvoluntary, biased and ungrounded excuses.

We reserve the right to amend, add or withdraw any of our booking terms and conditions at any time and without notice. 

Kaş Executive Offices and Courts are authorized for any dispute that may arise regarding the subjects covered by this contract. Any customer reserving and booking any of our villa/apartment is considered to have accepted all the above terms and conditions. Refusing these terms may result in cancellation of the reservation or booking and there will be no refunds made by Monix Homes.
